WILL OF JONATHAN L. ROOT (Died: 19 Mar 1885)
I Jonathan L. Root of the town of Barre, County of Orleans
And State of New York do make publish and declare this my last
Will & Testament in manner and form as follows:---
First After the payment of all my just debts, funeral expenses,
And expenses of administration I give and bequeath to the
Following named legalies & to their heirs, assigns and legal
Representatives, respectively, viz:---
To Abel C Root, who was brought up in my family $2000.00
To Avery S Root, who was brought up in my family $2000.00
To Jennie Root, who was brought up in my family $1000.00
To my hired hand, Samuel Allen, one thousand dollars
To Frank Allen, son of said Samuel, one hundred dollars
To my niece, Cornelia Nash, one thousand dollars
To my nephew, Chester Johnson, one thousand dollars
To my niece, Laura Richards, one thousand dollars
To my nephew, Elliot Johnson, one thousand dollars
To my niece, Martha P Remele, one thousand dollars
To my niece, Sarah E Tilton, one thousand dollars
To my niece, Alice G Page, one thousand dollars
To my niece, Ellen A Remele, five hundred dollars
To my niece, Grace Remele, five hundred dollars
To my nephew, Joel B Page, five hundred dollars
To my niece, Mattie Page, five hundred dollars
To my nephew, Harlain Page, five hundred dollars
To my nephew, Jame F Page, five hundred dollars
I give and bequeath to The First Presbyterian Society in
The town of Shelby---a religious society organized about the
Year 1822 and located at Millville the sum of one thousand
Dollars to be paid to the trustees there in office and used by
Them in their discretion for the benefit of said society.
Second All the legacies and bequests herein above specified
Are first to be paid and provided for out of my property, and
Said legacies are declared each to become due and payable and
To be paid one year next after the death of my present wife.
Nancy F Root without interest. All my property and estate both
Real and personal that may remain undisposed after paying my
Just debts, funeral expenses, and expenses of adminstration,
Together with all legacies above made--- I give and devise
And bequeath to my said wife to have the use, possession,
Produce, profit and control thereof from my death during her
natural life, for her benefit and enjoyment as she may see fit; and
she is authorized to lease, exchange, sell, donate, or dispose of the
same or any part thereof from time to time as fully as I may now
lawfully do, and as much of said property real or personal as may
remain at the time of death of my said wife, not disposed of by her
or by this will, I give, devise and bequeath to the heirs at law of my
said wife, her and their heirs and assigns absolutely to be divided among
them as estates are by law divided among heirs at law of persons
who may die intestate in the state of New York.
Third…I authorize and empower my executors of this will to sell any
or such part of my real or personal estate, as they may see fit to
carry the provisions of this will into full effect, and on any such
sale they or the survivors of them may make, execute and deliver
to a purchaser, or purchasers, all proper Deeds of conveyance of the
title in fee simple absolute.
Fourth…. I herby revoke all will by me heretofore made, and I
nominate and appoint my wife Nancy F Root to be executrix and
J Clark Parsons of the town of Gates to be executor of this my last
will and testament. If said J Clark Parsons shall be confirmed as
such executor by the surrogate court and if he survives my said wife
then he as such sole executors may finish the execution of this will
without another executor being appointed by the surrogate.
